Terms and Conditions of Sale

Ordering – When ordering MetaLink products, please specify product number, quantity and unit price. Telephone orders must be confirmed by purchase order. Fax or email of orders is acceptable and constitutes a confirmed purchase order. Delivery schedules shall be mutually agreed upon.

Prices – Prices do not include taxes, duties or shipping. All prices are F.O.B. Scottsdale, Arizona, United States. Note that MetaLink requires a minimum order of $50.

Payment Terms – Unless otherwise agreed upon, payment terms for domestic orders are Net 30 days from invoice date.

Shipment – All shipments by MetaLink are F.O.B. point of shipment in Scottsdale, Arizona. Title to hardware products and risk of loss pass to Buyer upon delivery to carrier at shipping point. Choice of carrier and method of shipment are the option of MetaLink unless specific instructions have been given by the Buyer in advance.

Return Policy – MetaLink provides a two-week trial period from invoice date for some products. If the product is returned within this two-week period, the full purchase price will be refunded. Before returning any item, you must first email (support@metaice.com) or call (1-480-926-0797) for a Return Merchandise Authorization (RMA) number. No returns will be accepted without an RMA number. The RMA number is valid for five days. Shipping, insurance and handling charges are not refundable. All products must be returned in “as-new” condition with all manuals, cables and accessories. Returns not following these guidelines are subject to a 25% restocking fee. Note that this return policy applies only to MetaLink manufactured products; the only return policy applicable to third party software or hardware products is that of the manufacturer.

International Sales – The Buyer must supply MetaLink with all necessary forms and documentation. The Buyer must also supply MetaLink with an import certificate for those countries requiring it. For all International sales, MetaLink shall require Buyer to provide payment in advance. International C.O.D. payment methods are also acceptable. Payment shall only be made in United States Dollars.

Limited Warranty – METALINK MAKES NO WARRANTIES OTHER THAN THOSE CONTAINED HEREIN AND METALINK EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE. The following limited warranties shall apply:

Emulators. All electronics contained in the MetaLink series of emulators are guaranteed against defects due to materials or workmanship for one (1) year period from invoice date. The MetaLink series of emulators contain no user-serviceable components. THIS WARRANTY IS VOIDED AND ANY UNPAID BALANCE IS DUE IMMEDIATELY IF AN EMULATOR’S SERIAL NUMBER HAS BEEN REMOVED OR TAMPERED WITH OR IF AN EMULATOR CHASSIS HAS BEEN DAMAGED OR OPENED FOR ANY REASON.

Emulator Probe Assembly. The emulator’s probe assembly is guaranteed against defects due to materials or workmanship for one (1) year period from invoice date. This warranty does not include damage to the pins of the probe assembly. Some MetaLink emulators are shipped with a special “Bondout” version of a device.  MetaLink’s warranty of this special device is limited to that of the manufacturer.

Repairs. MetaLink emulators serviced beyond their one-year warranty period are guaranteed against defects due to materials or workmanship for a 90-day period starting from the repair work’s invoice date. If an emulator is returned to MetaLink for non-warranty repairs and has payment due after six months from the date returned to MetaLink, it will be considered abandoned and will be disposed of by MetaLink. After this six month period there will be no claim against MetaLink for the emulator, a replacement emulator or a refund of the emulator's original purchase price.

No warranty extended by MetaLink shall apply to any goods which have been modified or altered by persons other than MetaLink’s authorized personnel or to goods that are defective due to misuse, neglect, improper installation, soldering or accident.

Note that this warranty applies only to MetaLink manufactured products; the only warranty applicable to third party software or hardware products is that of the manufacturer.

The foregoing limited warranties shall not apply unless Buyer has paid in full for the MetaLink products. 

MetaLink’s liability hereunder is expressly limited, at MetaLink’s option, to either:  a) the repair or replacement of the emulator that meet MetaLink’s Limited Warranty, or b) to a credit to Buyer in an amount equal to the Purchase Price of the emulator. IN NO EVENT SHALL METALINK BE LIABLE FOR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES, LOSSES OR EXPENSES DIRECTLY OR INDIRECTLY ARISING FROM THE SALE, HANDLING, INSTALLATION OR USE OF METALINK PRODUCTS OR FROM ANY OTHER CAUSE RELATED THERETO.

Controlling Law – MetaLink Corporation does business and is located solely in the State of Arizona. All orders or agreements and the rights of the parties hereunder shall be governed by the laws of the State of Arizona.

The MetaLink logo, MetaICE, and iceMASTER, are registered trademarks of MetaLink Corporation. The following are claimed trademarks of MetaLink Corporation and may be used only to describe MetaLink products: iceMASTER PE, MetaLink, MetaICE, and the combination of MetaICE, iceMASTER, and alphabetic or numeric suffix.  All prices are subject to change without notice.
